Joining battles (sides)

Could someone clarify the rules of the ability to join battles (and explain the reasons behind it) please?

 

I'm usually sailing in Jamaica under french flag, so i often see missions with english players fighting pirate AI. Sometimes i can join pirates, sometimes i can join Brittish and i just dont understand why.
